Monday, September 20, Jonathan Magbie, a 27 year old quadriplegic was sentenced to 10 days in a Washington, D.C jail. Four days later he died. [link] Why was he sentenced to jail? For possession of marijuana.
I try to be compassionate. But he broke the law they may have fucked up in jail and caused his death. But he deserved the punishment he recieved(not death the jail sentance). It's good not seeing them giving him special treatment because of his ailments. Marjuana is illegal like it or not its law. Protest it or make it change but he deserved his punishment.
This guy was not put in jail because of weed. He was put in jail because of cocaine and a gun in the car he was riding in. The judge said that she would have given him probation except for the gun and coke.
But let me re-clarify... this guy is a quad. He can't use his hands or legs. How the hell is he 'sposed to use a gun or even coke for that matter? This guy probably couldn't even control the fact he was in the car he was in.
I bet this is another case of a guy who follows his lawyer's advice to suck it up and take probation. The judge, knowing this, gave a harsher sentence.
Personally, if I go quad, you have my permission to give me the coke and then shoot me with the gun.
The guy is a quad. I doubt he had much control over whether there was a gun in the car or not.
I'm sure he had control over whether there was cocaine in his sytem or not, and that shouldn't be overlooked. But, if they really wanted to make some sort of example out of him and put him in jail, the least they could have done (and what they're required to do by law) is to provide him with adequate medical care.
We must be missing some of the facts in this case. This sounds too ridiculous to be true. But then based on the information we have, so does your response MB ;)
If common sense isn't used when prosecuting and passing judgment, the legal system would be paralyzed. And sometimes it's not as simple as "they broke the law, they deserve the punishment".
For example, I think there is a Tennessee law that says more than eight women may not live in the same house. Can understand why this would be on the books :) but do you think we should round up the offenders and throw 'em in jail?
In any case, I think our difference of opinion is based on the fact we have limited info, and if we both had the complete details, we'd probably agree he either deserved to have his lame ass thrown in jail, or that the judge is a fucking wacko. But before I'd pass "judgment" and say he deserves it, I'd want the complete details. BTW... I wouldn't put much weight on the fact he's a quad either.
In any case, here's a couple more sickly-entertaining thoughts...
How would a quad drive a car and use a gun anyway, especially at the same time? I have this image in my head and it just doesn't work for me...

On a more serious note, when sentencing someone for marijuana possession, can the judge take into account the gun, despite the quad not admitting to having it? Wonder who it was registered to? In any case, the charge and conviction was not around the gun, it was around marijuana possession, and despite there being laws against possession in most countries, in many places, the cops rarely bother enforcing. But that's another discussion all together...
I was going by the facts given I mean come on. I agree there was some serious neglegence when he died, but he broke the law he should be punished. Maybe not in jail but some how. That was the point I was trying to make.
